Attorney General Dana Nessel and her team of attorneys have taken a stand against Enbridge and the dangerous Line 5 pipeline. As a part of her case Nessel v. Enbridge, her team presented oral arguments to Ingham County Circuit Court Judge James S. Jamo, stating the pipeline must be shut down. This case is one of many efforts AG Nessel has taken to protect Michiganders, as Line 5 poses a significant risk to clean water in the Straits of Mackinac and the tourism industry in the northern part of the state.
These oral arguments defined Line 5 as a public nuisance that is illegally operating, citing violations of the Public Trust Doctrine and the Michigan Environmental Protection Act. This hearing was long-awaited, coming five years after Enbridge’s attempt to delay accountability by moving the case to a federal court was denied by the Sixth Circuit Court of Appeals.
Now, Enbridge is again trying to unlawfully extend its Line 5 pipeline operations, taking the case to the United States Supreme Court. There, the Supreme Court will decide whether the Sixth Circuit properly kept Nessel v. Enbridge in state court. This is yet another instance of Enbridge putting profits over the health and safety of Michiganders – and a disappointing refusal to protect one of Michigan’s biggest resources, our clean water.
Michigan LCV will continue to stand with Attorney General Nessel and the Department of Attorney General in their fight against Line 5, advocating for clean waterways, environmental protection and conservation, and holding corporations accountable for the pollution they cause.
