On December 6, 2023, Attorney General Dana Nessel took decisive action to protect Flint residents from harmful air pollution by securing a consent decree with RJ Torching, a scrap metal recycling company operating in the city. Following an investigation by Nessel’s office and the Michigan Department of Environment, Great Lakes, and Energy (EGLE), it was determined that the company had been violating air quality regulations, releasing high levels of hazardous pollutants, including lead and other harmful particulates.
The consent decree forces RJ Torching to take immediate corrective actions to significantly reduce its emissions, including installing pollution control technologies and conducting regular testing to ensure compliance with Michigan’s strict air quality standards. Additionally, the company is required to pay substantial fines for its violations and implement a community outreach program to inform Flint residents of the health risks associated with the facility’s operations.
Attorney General Nessel emphasized the urgency of the case, stating, “In communities already disproportionately burdened by environmental injustice, from historic industrial legacies to current-day emission loads, we must remain vigilant to enforce the laws that protect the people and public health.”
