On March 5, 2024, Attorney General Dana Nessel filed a lawsuit against J&D Brenner Farms, an unpermitted Concentrated Animal Feeding Operation (CAFO) located in Allegan County, for unlawfully discharging hazardous wastewater into a tributary of the Rabbit River. This discharge violated Michigan’s water quality laws and posed a significant risk to the local ecosystem.
The lawsuit seeks to compel the farm to halt its illegal practices and remediate any damage caused to the waterway. The improper disposal of wastewater from CAFOs is a known source of pollution, often leading to contamination of surface waters, which can harm aquatic life and impact drinking water sources. This legal action is an important step in ensuring that CAFOs adhere to the strict environmental standards necessary to protect Michigan’s water resources.
Attorney General Nessel’s office remains committed to holding corporations and operations accountable for violations that threaten the state’s environment. This case will send a strong message about Michigan’s dedication to enforcing its environmental laws and protecting the state’s waterways for current and future generations.
